Cornwall Drops Seniors Abba Noise Citation Case After Running Up Legal Bill MARCH 3, 2017

Cornwall Ontario –  The City of Cornwall instructed their high priced Ottawa legal reps at BLG to drop the case against Doug & Rachelle Raymond over the excessive noise citation given to the seniors for playing a Friday night card game in their backyard where they would listen to some 70’s background music.

The city is mum and zipped, refusing to answer who authorized the expenditures to fight for a $130 noise citation that their bylaw inspector didn’t even witness or hear.

Someone at City Hall should be held accountable, not only for the expenditure, but for the abuse of the Raymond’s who were fortunate to have the support of local Power Lawyer Andre Bourgon of Bourgon Law.   A defense for a case like this would normally cost approximately $6,000.00 just to get to trial.  Should seniors have to foot such bills in such dramatically wrongful actions by a municipality with no process to defend themselves other than such a trial?

Yes, they could have appeared before a justice without legal representation but there’s an old adage,

a man who is his own lawyer has a fool for a client

Especially with some of the judges and JP’s in this region.     It highlights a major issue with our justice system.

The entire concept of going to court when one is victimized is to be “made whole”.   In other words, for the injustice to be addressed.

That doesn’t happen often enough.  This writer can share that through my own experience in the courts here where you can actually win and still be left with the stain and loss of the injustice.  I myself am going through a slip and fall after a glass table was left in the entryway in the Morrisburg court house.   The table is no longer there, but after nearly one and a half years of patiently waiting for the court system to roll I just endured not one, but four high priced lawyers suggest it was my own fault so off we go to trial.  More time and expense for a clear case.

The Raymond’s sent in a note to CFN after their case.  Here is the first note we received prior.

My wife & I with our lawyer Andre Bourgon attended a pre-trial today regarding the fine($130) my wife Rachelle received on Aug 2/16 from the City’s by-law officers for excessive noise with our sound system on July 29/16.
As my wife is innocent of the charge our lawyer advised that we go to trial. The City’s lawyer agreed and the trial date is set for March 1, 2017.
This indicates how wasteful the City administration is by spending thousand of dollars of taxpayers money  on legal fees in trying to recoup $130.
I  also hope this is an eye opener for city councillors to react on this issue.

Douglas & Rachelle Raymond
And the note after the trial eight months later.
Hi Jamie

Yes, the City has withdrawn their charges against us regarding the noise (music) complaint.

We received the news from our lawyer Andre Bourgon on Monday Feb 27/17 two days before the trial scheduled for March 1/17.

The reason for the City’s decision is that the by-law officer could not be reached on the day of the complaint (July 29/16) and therefore had no evidence. But they still gave us a ticket 3 days later.(August 2/16)

We will be attending court with our lawyer on March 1/17 to request compensation for legal costs.

We would like to thank our lawyer Andre Bourgon for his excellent service and CFN (Jamie Gilcig) and all the readers who supported us.

Enjoy the Music

Doug & Rachelle Raymond
We are delighted with the outcome yet we would have wanted an opportunity to defend the charge and have a Judge determine the merits of the charge.
Clearly decisions in the process could have been made to prevent abuse to the Raymond’s and cost to the city.
.
While one could blame the by law officer, who appears to not be employed with the city any longer, some decided to push this case whether it be Chris Rogers, Mark Boileau, or ultimately Maureen Adams herself.
.
Incidents like this should not happen in our city, but if no one is held accountable at City Hall what are the odds of that happening?
.
Spring is coming and the Raymond’s will be able to enjoy their Friday night card games again, but their case should be a warning for all when it comes to government abuse here in Cornwall Ontario.

Sunshine List Darren Dalgleish Lawyers UP – Is he still CEO of St. Lawrence Parks? MARCH 9, 2017

Cornwall Ontario – Darren Dalgleish has lawyered up.    The we’re not sure what, or if he’s still with,  the St.Lawrence Parks Commission poobah,  was allegedly reported to have been escorted from the premises and turfed which has resulted in Cornwall Newswatch’s Bill Kingston and other media outlets to be served after reporting such.

CKWS in Kingston backtracked as well with a clarification:

Editor’s Note – On March 7, 2017, CKWS TV published a story concerning the employment status of Darren Dalgleish, CEO of St. Lawrence Parks Commission. After being reviewed by senior news managers, a decision was made to re-edit the original article in the interests of clarity. We are currently not able to verify that the Park’s Commission has “parted ways” with Mr. Dalgleish. The updated version of the story reports instead that an “interim CEO” has been appointed. CKWS apologizes for any confusion we may have caused.

Now that’s some great mitigating.

According to media reports calls to his office line get transferred to another party.

Apparently Bill Kingston published certain allegations without enough proof or once the lawyers started people are backtracking?  We may never truly know the truth about Mr. Dalgleish and his Sunshine list salary.

Calls to Ministry of Tourism and other entities are being stone walled with no clear answers.

This writer has had few interactions with Mr. Dalgleish; chiefly because he’s been a swinish brute to this outlet.   If some of the rumors floating are remotely true he may be making his lawyers very happy in the near future.

Marc & Jodie Emery Doth Protest Too Much Methinks by Jamie Gilcig MARCH 12, 2017

$

Cornwall Ontario – Marc Emery has led an interesting crusade in the name of making Marijuana legal and accessible to Canadians.

He, his wife Jodie, and his supporters,  along with others in the mostly BC led industry deserve thanks from all Canadians who think it’s insane for marijuana to be prohibited while tobacco and alcohol can be purchased in grocery stores.

They’ve paid the price too, but the escalating push and shove has led to brutal treatment of the couple by police recently when they were arrested in Toronto.  Both were strip searched.   This writer can only imagine the purpose of such a search was to intimidate and punish the couple.   This is not how we should be doing things in Canada.

Likewise the couple are now prevented from running not only their dispensaries, but from publishing their magazine, and running their marijuana related business.  When did Russia or China take over policing and our justice system in Canada?  That seems overly punitive to this writer and to most reasonable persons.   These are not bikers or violent criminals.   This is not organized crime.   These are people that have been in the light and operating in the open fighting for a cause they believe in of which the Prime Minister and his government actually appear to agree on in principal. Surely there are more civilized ways to resolve this mess?

It seems apparent that the Emery’s have ruffled the feathers of Prime Minister Justin Trudeau, from even before he became PM.

Here is a the last time I was given access to Mr. Trudeau.  I have not been given any access since asking about Mr. Emery while he was incarcerated in the US which I believe should never have happened and was a sovereignty issue which Mr. Trudeau essentially stayed silent on; which is odd for a politician campaigning and asking for the pro marijuana community’s support.

At the crux of the issue is of course, as always, money.   The marijuana industry is huge.  In BC it may be one of the largest industries in the province.  It will be a major election issue, but it’s handling so far has reeked of political back room cashola deals from Liberal bag man Chuck Rifici’s role with Tweed to essentially forcing medical marijuana users to purchase from licensed distributors; some of whom have been caught selling tainted product.

Canadians have been smoking marijuana for an awfully long time.   Most would never think of arsenic dangers from product purchased via government license.

At root is the battle of the big licensed distribs, and entities like Shoppers Drugmart and Loblaws who want to sell marijuana once it’s legal recreationally, and people like the Emery’s and others, who’ve been leading the charge since about day one.

Opening street dispensaries PRIOR to legalization is of course breaking the law.  So is Jay Walking.  So is travelling 101 kph on Highway 401, but rarely are lawbreakers of that nature prosecuted.

By spending tax dollars to shut down dispensaries, especially in the manner being done, simply will clog up our courts with cases that at the end of the day most likely will not result in convictions.  How does a judge punish someone for something that the Prime Minister and his government have clearly indicated would be legal in 2017?

It’s also a lost opportunity for police to be able to study the impact of street dispensaries impact on local crime leading up to legalization.

While some push and shove is still needed to make sure that the Trudeau government keeps at least this one promise he made during the campaign; surely who can access and sell marijuana should be treated in a similar manner to beer and wine?    Canadians can legally brew their own alcohol.   Likewise stores sell kits and even will assist you to brew without fear of police smashing down their doors and seizing their goods.

In Ontario you can purchase your Guinness cans at a grocery store or beer store.   You can brew your own suds.   You can order it online.  You essentially have an open marketplace.  Why not for Marijuana other than a lot of cash given by the licensed distributors, and the tax stream that is more easily monitored via them.   You can’t blame them for wanting to maximize the return on their investment, but at the end of the day if you make marijuana expensive, as most of the LD’s do, people will purchase higher quality product in many cases, for less, from their black market dealers.

It’s a challenge that may actually see the Trudeau government defeated in the next election because the Marijuana movement and especially the blocks of voters in BC, and other nuggets of Canada don’t want to feel boondoggled.

Mr. Trudeau should be sending out clear signals that his promise will be kept or not.   Marijuana should be as NDP leader Thomas Mulcair has suggested,  decriminalized.    There are communities in Canada that have given street dispensaries licenses or where police don’t go breaking down doors.

Note: There is a poll embedded within this post, please visit the site to participate in this post’s poll.

There are police chiefs that have stated there are bigger things they should be using their limited resources on.

While the Emery’s have crossed lines and seem to want to grab the biggest headlines and attention in their fight for not only legalization, but for Canadians to be able to truly enjoy the benefits economically of working in the Marijuana industry they clearly are now paying the price for it, as are others who have opened up street dispensaries.   Clearly the police and politicians like our PM seem to have bit the bait, at least mostly in Liberal bastions like Ontario and Quebec.

Now it’s about following the smoke and seeing where it leads….

City & Counties Squabble Goes Public – Highlights Need for Amalgamation by Jamie Gilcig MARCh 14, 2017

Cornwall Ontario – The Counties of SD&G and the City of Cornwall are essentially waving their dirty laundry around as they duke it out in public over their shared services issues.

Essentially both councils lack the ability to professionally work together.  The County for example, did not send their letter to this media outlet even though we’re the largest in the region chiefly because of the pettiness of a certain partisan Bruin’s loving political clique.

The City, leading a fiscal conspiratorial boycott against CFN still knows the impact of CFN and does send us their releases. (unless Kevin Lajoie is being a moody mare)

At root of this scrap is the simple ability to resolve shared services that the province forces on both parties, and potential shared services  that aren’t.

In principle that makes a lot of sense, but then so does Amalgamation  which would see an entity of about 100,000 residents in total.

Is there any real need to have to councils, support staffs, department duplication, etc when it’s essentially all coming out of one pocket?

There’s an old adage about getting the government one deserves.  Clearly we are seeing the fruits of that adage watching this dysfunctional group of petty people who feel entitled to run a civic government as a private closed shop for their supporters, friends, and family.

For this to go public a reasonable person could only shutter about what’s not public…

Here is the original letter from the Counties to City Hall:

Of course most of the warfare is between management staff.  Talk to some of these elected officials and I’d put money on my dachshund Fitzy over some of them if they were playing Jeopardy.

Mayor O’Shaughnessy had a staffer fire back a long winded letter:

Your tax dollars at work.   Over 15 elected officials can’t even get to first base on a very important file.  Is it the elected officials?  Staffers?  Both?  The dysfunctional system of police cronyism and bullying?  Too much fluoride in the water?   Too much Scotch?

But mostly we all should remember how important our vote is and how badly some of these folks have been performing.  Care about school closures?  Did you even vote for a school trustee?   Your vote counts.

Note: There is a poll embedded within this post, please visit the site to participate in this post’s poll.

What do you think dear CFN viewers?  You can post your comments below and please click the donate button you cheap news moochers 🙂      Because of the silly conspiratorial boycott that both the United Counties of SD&G  (have never purchased a single ad or notice) and City of Cornwall participate in we need you all to kick in so we can continue to deliver the news you clearly love to click on.

It will continue throughout the night. A widespread 15 to 25 centimetre snowfall is expected. Total snowfall amounts reaching 30 centimetres are likely, especially near the St. Lawrence River.

Strong and gusty northeasterly winds will whip up the freshly fallen snow resulting in frequent blowing snow in most areas.

Canadian Legion Hypocrisy Over the Arthur Murray Cornwall 419 Case by Jamie Gilcig – MARCH 16, 2017

Cornwall Ontario – Franckly (yes, spelled that way on purpose) it was most disturbing to see the Canadian Legion roll out the dog and pony show over Franck Gervais who misguidedly and apparently well intentioned, was charged under section 419 of the Canadian Criminal code for wearing a military uniform.

Legion Dominion Secretary Brad White was especially quoted on the Gervais file.

“The Royal Canadian Legion is concerned and angered that there are Canadians who for their own self-promotion and aggrandizement wear medals and insignia that they have no right to wear,” Legion dominion secretary Brad White said.

“It is an act of disrespect to all those who have served.”

This writer attempted multiple times to discuss the Arthur Murray situation with Secretary White and several other higher ups with the Canadian Legion without a single comment or response.

In essence they turtled and hid.   For an organisation that represents what the Canadian Legion is supposed to represent such cowardly behavior franckly (did it again) should be grounds for resignation.

Same for President Linda Fisher and the rest of her board locally.  They should resign for dereliction of duty simply for not pressing a charge against Mr. Murray who clearly has lied about his service, medals, and role in our great military while actually presiding as 1st VP of the local squad, and presiding over Remembrance Day activities.

Ms Fisher had a few spin quotes for other media.

Ken Heagle, immediate Past-President of the Legion and Veteran Services Officer said that at the Legion Zone Council meeting in March, branches in the region will be notified that Murray is no longer a member and that he is not welcome at any branches. Murray also will not be able to re-apply for membership.

Fisher said that had Murray not resigned the Legion Branch would have had to expel him.

All of the members of the Legion Branch 297 Executive Committee said that they were shocked by the revelations of about Murray.

“His own family didn’t even know,” said Bernadette Heagle, the new First Vice President at the Legion. “He was always very knowledgeable so why would you question it?”

But again, Franckly, you can’t lead the charge against poor Franck Gervais who was put through the ringer or even compare what he did versus the fraud that was Arthur Murray who actually was also entrusted with working with cadets at the Legion.

Franckly there was only one clear path to take once the truth came out and the Legion, from the local branch to Mr. White and other poobahs clearly did not do their duty in this situation.

The biggest question many should be asking is why?   This writer will not speculate on that answer, but when you have someone in military intelligence standing in the photo above with Mr. Murray clearly how he came to be in his position begs further questions.

This is no longer just a local issue as Mr. White and his confreres cowardly lack of response regarding this case, which CFN broke locally only after several vets brought the story to us.  (The Freeholder knew prior, but only covered it after our second release on the case.)

Likewise, the claim that Mr. Murray had been in the reserves was not supported or documented in any fashion.

Surely if Mr. Murray was in fact a veteran of the reserves he wouldn’t be barred from being a member if he so wished?

But again, Franckly, the Legion still hasn’t done anything about the Jim Brownell Poppy incident either.  Mr. Brownell, while actively posting in a hate group on facebook with his profile pic of him in the Glen’s uniform, typed the words “I am not by brother’s keeper.” in response to the desecration of the poppy which ironically is exactly what our brave men and women of the armed service in fact do.

What do you think dear CFN viewers and those that actually truly care about what the Poppy stands for and how important our vets truly are.   You can post your comments below.
