Busy Sunday (August 11) coming up at Cornwall Motor Speedway! by Martin Bélanger

Cornwall Motor Speedway A busy Sunday ahead at Cornwall Motor Speedway with 6 feature races planned on the schedule as the Sportsman will have double feature with the June 23rd being completed, Modifieds, Pro-Stock, Semi-Pro and Mini-Stock will also be on the racing night sponsored by Cayer Motor Sales.

 

A great battle between two drivers should decide the point’s title in the Jiffy Auto Services Modified category as Luke Whitteker leads the way with 394 points, only ten points in front of veteran Mario Clair who decided to run Cornwall this season. Local runner Brian McDonald is having a nice season holding on third over Chris Raabe and Stephane Lafrance completes the top 5. A few drivers are knocking at the door for a place in the top 5 as Kayle Robidoux and Kyle Dingwall are less than 6 points from Lafrance. A 30-lap affair is schedule for Sunday.

 

An important night for the Storm Realty Tracy Wheeler Sportsman as two 20-lap feature race will be run with the June 23rd feature race being completed. The championship is really close as Chris Herbison and Joey Ladouceur are tied in first with 322 points with last Sunday`s winner, Corey Wheeler getting closer with only 4 points behind the leaders. With 5 events to be done until September, it will be interesting to follow this great battle!

 

A different scenario in the Alexandria Home Hardware Pro-Stock division as Dave Bissonnette has a 28-point edge over Roch Aubin and 62 on Jocelyn Roy. Bissonnette needs to show is common regularity and the championship should be his, with 4 nights of racing including a 20-lap finale on Sunday, there is a lot of action left in the Pro-Stock ranks.

 

Seeing little action so far in 2013, the Evans Bus Lines Semi-Pro is returning Sunday with a 15-lap feature. Three drivers are in direct competition for the title as 3-time winner in 2013, Derek Cryderman hold a slim 4-point margin over Kevin Fetterly and 6 points on Steve Billings. Nothing is decided yet as 3 features are left until September.

 

Being constant, is key to win a championship, Mike Gaucher is a great example, after winning 3 features in a row, he finished far in the field last week and the Baxtrom YIG Mini-Stock championship is now really tight as Gaucher only has a slight 3-point margin over Danny Lefebvre. Rookie contender Marc Reggentin is currently third. A special 25-lap feature is schedule for them on Sunday.

 

Pit Gates will open at 4:30pm with general admission opening at 5:30pm. The first heat is scheduled for 7pm. General Admission will costs 10$ with children 18 years and under only 2$, seniors 65 and over will be 5$ and Pit Admission will be $23. A really great deal to see 6 features in one night!

Why Won’t Cornwall Ontario Support Live Music? Toronto Rocks Out at The Port Theatre

Toronto RED aug 9 2013CFN – So I went to three musical events in Cornwall this past week at three different venues.   All were under attended.  At least one of the gigs was heavily promoted so the question is “Does Cornwall Ontario support live music?”

While I get that different types of music attract different crowds the three events I caught this week all should have drawn larger crowds especially as two of them were free!

So many complain about a lack of entertainment; but then don’t support live acts when they’re present.   Even Lift Off was a dud this year.

And under inspiring crowds lead to promoters taking less risks and investing less in shows which becomes a circle of doom.

Friday night however a lot of people missed a great show at the Port Theatre which is starting to see a future as a live event venue as film crumbles.

The days of 500 seat movie houses may be over, but the sound in the Port holds a bright future and hopefully the day will be when this amazing venue sees at least 100 days per year of activity.  With the Aultsville Theatre (which the city funds for nearly $100K per year!) having less gigs the Port is the best venue right now for live entertainment available.

Lost boyz

Local 80′s Tribute Band Lost Boyz opened for Toronto the night before they hit Ribfest in Brockville.  The “boyz” did a great job delivering hit after hit to warm up the crowd!

Next up at the Port is a Country tribute to George Jones on August 30th.

Chris Raabe wins second event of 2013 at Cornwall Motor Speedway! by Martin Bélanger August 12, 2013

 CMS-480x140-2013-04-21CFN – A busy night of racing at Cornwall Motor Speedway with 6 features race as the Sportsman had double feature and Mini-Stock had a 25-lap feature race on Cayer Motor Sales Night.

 

The 30-lap Modified Jiffy Auto Services feature saw Marc Therrien took the early lead as Tim O’Brien and Stéphane Lafrance are running in the top 3 as caution came out on lap 5 for Travis Stacey. On the following green, Chris Raabe rocketed into first place from his fourth starting spot and led 3 laps as caution came out as Roger Levesque stopped in the backstretch. Raabe leads the way with O’Brien and Therrien still holding their position with 20 laps in. A few caution slowed the field between laps 20 and 23. A lap 24 restart saw Raabe in the lead with Laurent Ladouceur now third as Mario Clair was running in fourth. Caution came out on lap 26, when the green lights came out, Clair jumped from fourth to second just before Brian McDonald stopped in turn 2 with two laps to go. Raabe led the final circuits to win his second feature of 2013 over Clair and Ladouceur.

 

In the Alexandria Home Hardware 20-lap, David Seguin was the initial leader but got passed by George Renaud on lap 6, as Jocelyn Roy was able to jump to second at halfway point. A good battle between Renaud and Roy as they ran side by side for several laps, both drivers swapped the lead until Stéphane Lebrun brought the caution with 2 laps to go. Renaud finally got the lead for good winning his first feature this season over Roy and Roch Aubin.

 

The night started with the makeup feature for the Tracy Wheeler Storm Realty Sportsman Feature of June 23rd, Corey Winters took the early lead followed by John Mills and Patrice Dumouchel. Jenna David stopped in the backstretch and yellow was out on lap 6. On the restart, John Mills jumped in the lead as Corey Wheeler got to third. Mills built himself a sizeable lead on the field as 3 cars got together on last lap giving us a green-white-checker finish. Mills is able to resist winning his first feature of the season in front of Winters and Chris Herbison.

 

The regular 20-lap Tracy Wheeler Storm Realty Sportsman Feature saw Bill Mullin in the lead as 2 laps were completed before an accident occurred in the backstretch. Mullin the leader with Robert Delormier and Ryan Stabler making his way to third place with 5 laps completed. Mullin had built himself a good lead on Delormier with only 5 laps to go. Mullin led the final laps to capture his second feature of 2013 over Delormier, Stabler, Mills and Jackson completed the top 5.

 

The Evans Bus Line Semi-Pro feature was the last race of the evening with a 15-lap event, the lead changed hands several times in the first portion as Derek Cryderman was the leader with 5 laps completed. Cryderman never looked back and won his fourth feature of 2013 in front of Steve Billings and Dave Renaud.

 

A strong field of 23 cars took the initial green of the special 25-lap Baxtrom YIG Mini-Stock feature. Joel Pilon took the lead as Francis Blanchette was second. Pilon made his into traffic with 8 laps completed as Joe McNicholls was running in third. McNicholls used slower cars to grab the lead in turn 2 on lap 17. The first caution was out on lap 19 as Francis Blanchette got hit in turn 1. On the restart, McNicholls had Justin Desrosiers and Quincy Roberts as dancing partners. McNicholls led the final laps to win the feature over Pilon who made a final attempt on the last lap and Roberts.

 

Next week, Jim`s Performance Plus will sponsor a full program of racing for Modified, Sportsman, Pro-Stock and Mini-Stock. The SpeedSTR will make their annual trip to the speedway.

jg2CFN – Pink Politics are again raging in the headlines.    This time the cause is the 2014 Winter

Olympic games in Sochi Russia.   Because of new laws (horrible ones too) passed by Mr. Putin and his government in Russia activists like the witty and talented George Takei are suggesting that the Olympics be moved to Vancouver BC for fears of punitive actions and possible attacks not only on Gay athletes, but simply anyone that supports equality.

The Olympic organizers are asking for clarification of the new laws which have not met any challenges in any courts as of yet, but do have some punitive and bizarre language in the translations at least.

In the video above Mr. Takei suggested negative effects on the sponsors and big money associated against the Olympics.   Vodka is now being boycotted by many bars and businesses as well.   The push is on to punish Russia for its new law.

The law, originally titled “the law against homosexual propaganda”  was passed Unanimously, 436-0.

Holding a Gay Pride even, asking for equality, or speaking in defense of gay rights can lead to huge fines (over 30K) and other severe penalties.

Even the artistic soul of Russia, St. Petersburg, passed the law regionally.

While Russia has been a hot mess of a country, fighting off a declining population that has wrestled with the death of its communist rule to the wild and wooly changes since and the retrenchment of its Orthodox Church Homosexuality is not something new to Russia or its history.

While the gay press are Godwinning themselves by trying to connect the dots between the Nuremburg laws and this bizarre mess of legislation I don’t think moving the games is the solution.  I also think that sometimes we have to think about the head space or thought process of the other side.  Why is it that Russia is coming out with such a Draconian law?    Is the Gay community missing out an opportunity to understand what could be triggering this sort of mentality?  Does being gay make you Superman or Superwoman?  Do you have more rights than the hetero world?   Is it about equality or branding?  Is there a political agenda at foot?

In the tradition of Jesse Owens I think the game, although a bit risky, is to attend the games and challenge the laws.

When the Pussy Riot girls were jailed the world spoke.   This is what Russia is.  This is what the people of this country have chosen.  The Olympic committee chose to have the games in Russia.  While boycotting is a legitimate option it fails to put the question on the biggest platform and in front of the largest microphone in the world at a given moment.

Maybe a new patch of support that athletes can wear?   Maybe some of the openly gay athletes that win can say something.

To me it’s not waving a red flag in a big nasty bull’s face; but communicating the masses.    While moving the games to Vancouver may be a great solution for Canada is it really a great solution to the question?

And if any Athletes or those travelling with the games are charged what better time to challenge the law in an International court system under world scrutiny?

No, I think this time George Takei may be wrong.   Maybe we should be asking what William Shatner would do in this situation?

Ontario Premier Kathleen Wynne Drives Her Big Red Truck in Cornwall Ontario – August 12, 2013

Wynne Truck CornwallCFN – Ontario Premier Kathleen Wynne was in Cornwall Ontario at a local Trucking firm that received funding to help create a few jobs.

It’s the photo junket season with the Preme hopping from town to town pressing the flesh and meeting some of the community.

She had a chance to drive a big red truck too!

 

Sadly due to some favoritism miscommunication I elected to not wait, and wait, to ask some questions of our Premier.  Some of which were probably pretty darn good too….

Congrats to local firm Minimax Express Cornwall and the Poirier family on their funding!

Beavergate in Cornwall Ontario One Year Later – It was a Success! Clear Guindon Park Waters with no Flooding!

wyatt guindon park aug 8 2013CFN – What a difference a year makes.  When we started the Beavergate Protest we never expected that the devices placed in the Guindon Nature Park in Cornwall Ontario would have such dramatic results.

Funded fully by Lesley Fox and her Fur Bearer Defenders organization the road to clearer waters and healthier habitat were started by Wyatt Walsh pictured above.

Instead of signs that dogs and small children can’t read there is lush green.   Mr. Walsh had one abortive attempt after contacting the Standard Freeholder go on deaf ears before CFN became active in trying to find a solution.

Our request for a 90 day moratorium on trapping to the City last year resulted in the traps being moved next to the lodge and wiping out the family of beavers lived.

That’s when local activist and musician Rebecca Sorrell entered and then with some media momentum and help from Lesley Fox and her organization oiula!

Even though with near record rainfall the park was not flooded.  Nor did the beavers eat all the trees as some suggested would happen.

 The park has never looked better.

All we had asked for originally was a moratorium simply to discuss alternatives to trapping.  Sadly it go messy because of closed minds and only when the threat of National humiliation and free implementation did the Kilger regime agree to change.

As a matter of fact OPG (Ontario Power Generation) rep and now retired Linda Haliday actually refused to participate in one group meeting if I was present; that’s how nasty it got to get to this point.

Let them eat beaverSad, don’t you think?  Especially when Lawyer and ambitious politician  Bernadette Clement sat on the board of the River Institute at the time.

The River Institute did not assist or help with this project.  There was only one city councilor who showed support, but he chickened out and refused to go public.

The City of Cornwall did not respond for comment to this story.

Cornwall, ON- The Cornwall Community Police Service have received reports of  individuals identifying themselves as government employees needing to gain access into residences to confirm their furnaces are in compliance. These individuals can be persuasive and sometimes forceful claiming “it’s the law you need to let us in”. If you are pressured to make a big purchase decision or an immediate decision, it’s probably not a legitimate deal. Real businesses or charities will give you a chance to check them out or think about it.

 

The Cornwall Community Police Service wishes to remind residence never give out any personal information in person, over the telephone or the internet without researching and confirming who you are talking to.

MISCHIEF UNDER $5000 AND BREACH

 

            Cornwall, ON – Alcide Ceaser, 50 of Cornwall was arrested on the 9th of August, 2013 and charged with Mischief Under $5000 and breach of his Probation order for not keeping the peace. It is alleged that on the 6th of August, 2013 he damaged some plumbing at an apartment on Adolphus Street causing the water to leek. Police were contacted and an investigation ensued. During their investigation on the 9th of August, 2013 they located the man at a Fennel Street address, took him into custody and charged him accordingly. He was transported to police headquarters where he was released with a future court date.

 

IMPAIRED OPERATION

 

Cornwall, ON – Sophie Oxley-Hall, 28 of Ottawa was arrested on the 9th of August, 2013. It is alleged that shortly after 11pmon the 9th of August, 2013 the woman was found to be operating a motor vehicle while under the influence of alcohol on Brookdale Avenue. She was taken into custody then released with a court date of the 15th of August, 2013.

 

DOMESTIC, ASSAULT WITH A WEAPON AND POSSESSION OF A WEAPON FOR A DANGEROUSE PURPOSE

 

            Cornwall, ON – A 30-year-old Cornwall man was arrested on the 10th of August, 2013 and charged with Assault with a weapon and Possession of a Weapon for a Dangerous Purpose. It is alleged that on the 10th of August, 2013 the intoxicated man entered his bedroom and made a gesture towards his 32-year-old wife with a knife. Police were contacted and an investigation ensued. During their investigation they took the man into custody and charged him accordingly. He was transported to police headquarters and held for a bail hearing. His name was not released as it might identify the victim.

 

DOMESTIC ASSAULT WITH A WEAPON AND FORCIBLE CONFINEMENT

 

            Cornwall, ON – A 33-year-old Cornwall man was arrested on the 11th of August, 2013 and charged with Assault with a Weapon and Forcible confinement. It is alleged that on the 11th of August, 2013 the man attended his ex-wife’s apartment pushed open the door causing the door to strike her and then refused to let her leave the apartment. Police were contacted and an investigation ensued. During their investigation the man who was still on scene was taken into custody and charged accordingly. He was transported to police headquarters and held for a bail hearing. His name was not released as it might identify the victim.

 

DOMESTIC ASSAULT

 

            Cornwall, ON – A 27-year-old Cornwall man was arrested on the 11th of August, 2013 and charged with Assault. It is alleged that on the 11th of August, 2013 the man was involved in an argument with his 23-year-old wife and during the argument the man pushed the woman on different occasions. Police were contacted and an investigation ensued. During their investigation police took the man into custody and charged him accordingly. He was transported to police headquarters and held for a bail hearing. His name was not released as it might identify the victim.

 

DOMESTIC ASSAULT AND THREATS

 

            Cornwall, ON – A 31-year-old Cornwall man was arrested on the 11th of August, 2013 and charged with Assault and Threats to life. It is alleged that on the 11th of August, 2013 the intoxicated man was involved in an argument with his 31-year-old common law wife and pulled her out of bed then threatened her life. Police were later contacted and an investigation ensued. During their investigation they attended the residence, took the man into custody and charged him accordingly. He was transported to police headquarters and later released with a court date of the 10th of September, 2013. His name was not released as it might identify the victim.

 

THREATS

 

            Cornwall, ON – Eric Chartrand, 41 of Cornwall was arrested on the 10th of August, 2013 and charged with uttering threats to life. It is alleged that on the 10th of August, 2013 there was a verbal argument between two neighbours on Dunbar Street and during the argument the man threatened the life of his 45-year-old neighbour. Police were contacted and an investigation ensued. During their investigation they took the man into custody and charged him accordingly. He was transported to police headquarters and released with a future court date.

 

ASSAULT

 

            Cornwall, ON – Kayla Boyd, 22 of Cornwall was arrested on the 11th of August, 2013 and charged with assault. It is alleged that on the 11th of August, 2013 the woman attended a Third Street apartment and while the 33-year-old female resident answered the door the woman pushed her back and entered. Police were contacted and an investigation ensued. During their investigation they spotted the female walking in the area of Fourth Street and Cumberland Street, took her into custody and charged her accordingly. The woman was transported to police headquarters and held for a bail hearing.

 

BREACH OF A PROHIBITION ORDER

 

            Cornwall, ON –Marc Lauzon, 50 of Cornwall was arrested on the 10th of August, 2013. It is alleged that on the 10th of August, 2013 the man was spotted by a member of the Cornwall Community Police at the Optimist Park. The man is known to police to be bound by a Prohibition Order with conditions not to attend any public park where it can be expected that children under the age of 14 might be. The man was taken into custody and charged accordingly. He was transported to police headquarters and held for a bail hearing.

 

ASSAULT AND BREACHES

 

            Cornwall, ON – Adam Bouchard, 24 of Cornwall was arrested on the 11th of August, 2013 and charged with Assault and Breach of a Probation order and an Undertaking for having consumed alcohol and failing to keep the peace. It is alleged that on the 11th of August, 2013 while at his apartment an argument took place with a 19-year-old man. During the argument the man grabbed and pushed the 19-year-old causing him to fall. Police were contacted and an investigation ensued. During their investigation the man was taken into custody and charged accordingly. He was transported to police headquarters and held for a bail hearing.

 

CRIMINAL HARASSMENT

 

            Cornwall, ON – Bernard Prevost, 42 of Cornwall was arrested on the 11th of August, 2013 and charged with two counts of Harassment. It is alleged that on the 8th of August, 2013 the man attended a 29-year-old woman’s apartment and began banging at the door all the while screaming. On the 9th of August, 2013 the man confronted the woman in front of their Fourth Street apartment building and began to yell and scream at her. Police were contacted and an investigation ensued. During their investigation it was learned that the man had been previously warned by police in relation to Harassment and on the 11th of August, 2013 they spotted the man at a convenience store, took him into custody and charged him accordingly. He was transported to police headquarters and released with a court date of the 17th of September, 2013.

From the Ottawa Police Service;

The Ottawa Police Service Sexual Assault/Child Abuse Section is investigating the report of a Sexual Assault that occurred on August 7, 2013 at the Walter Baker Park near the Kanata Recreation Center Arena.
At approximately 10:30 pm, a 17-year-old woman was inappropriately touched by a male that came up behind her. He then ran towards the Kanata Recreation Center.
The suspect is described as approximately 6’0 tall(183 cm), broad shoulders, dressed all in dark clothing including a dark hoodie and wearing a black Morph mask.
Anyone with information is asked to contact the Ottawa Police Sexual Assault/Child Abuse Section at 613-236-1222, ext. 5944 or Crime Stoppers at 613-233-8477 (TIPS) or toll free at 1-800-222-8477.

 

The Ottawa Police Robbery Unit has laid charges in connection to a March home invasion and an arrest warrant has been issued for one female suspect.

On March 19, 2013, at approximately 8:00 pm, a male (aged late 60’s) answered a knock to his apartment door, the building being situated along the 600 block of Rideau Street. At that time, three females pushed their way into the apartment. Once inside, the women drank any alcoholic beverages the victim had on hand. When the victim got upset and threatened to call police, two of the women threw him to the floor, held him down, and stole his wallet. The third woman cut the victim’s phone to prevent him calling for help. On the way out of the apartment, the women also stole the victim’s DVD player.

One suspect, Marilyn GENAILLE, age 50 of Ottawa, was arrested days later and is currently in custody serving a serving a 6 month sentence in relation to this incident.

A second suspect, Cory GREEN, age 25 of Ottawa, was arrested and charged on July 29, 2013. She is charged with robbery, intimidation, forcible confinement, being unlawfully in a dwelling house, mischief under $5000 and conspiracy to commit an indictable offence. Green remains in custody and appeared by video in court on August 6, 2013.

The third suspect, Christine GREEN, age 22 of Ottawa, is now also wanted and an arrest warrant has been issued. She has been charged with robbery, intimidation, forcible confinement, being unlawfully in a dwelling house, mischief under $5000 and conspiracy to commit an indictable offence. Her current whereabouts are unknown but she is known to frequent the Market area. Christine Green is described as being 5’9”(175 cm), 200 lbs (91 kg), brown eyes, brown hair (see attached photo).

CFN- South Stormont Township has made a pitch to R.W. Tomlinson for them to locate a Concrete plant that was rejected by Brockville Ontario on a property that they feel would meet the company’s criteria and is already zoned appropriately.

South Stormont is always focused on bringing strong economic development to our growing community.

In talking with Mayor McGillis he shared that South Stormont had some choice locations for growth and expansion.

The plant and the approximately 40 jobs that would come with it don’t seem to be exciting to Cornwall Economic Development officer Mark Boileau according to media reports.

The Tomlinson Group applied to have a 44 acre parcel in Brockville rezoned, but was met with community activism in rejecting the proposal which ideally would be near or on the waterfront.

Ralph Tomlinson founded R.W. Tomlinson Cartage in 1952 with one single-axle dump truck. Incorporated as R.W. Tomlinson Limited in 1969, the company is now a prominent player in quarrying, construction, trucking and environmental industries, with a large fleet of company-owned vehicles in Eastern Canada.

The Ontario Fire Marshall’s office has completed a review of the Cornwall Fire Service making twenty-eight recommendations that will be presented to Cornwall City Council tonight. The review identifies issues in the delivery of Fire Prevention responsibilities in addition to important health and safety issues for Cornwall’s residents.  The review concludes, in part:

 

“This review has determined that the City of Cornwall is not meeting minimum legislated requirements. It identifies inconsistencies and deficiencies in the delivery of fire protection services in the City of Cornwall.” It goes on to state: “Reducing or eliminating deficiencies will improve the safety of the public and front line fire service personnel, and may reduce municipal liability.”

 

Cornwall Professional Fire Fighters Association President Bruce Donig said his members fully endorse the review’s conclusions. “The review makes clear what fire fighters in Cornwall have been saying for years, there are significant public and fire fighter safety issues in the Cornwall Fire Service that need to be addressed”

 

Donig went on to say “We are encouraged that the report concludes that fire fighters require more training, we have been asking for more training for years.  Imagine a workplace where the employees want more training but don’t receive it from their employer.”

 

President Donig concludes, “I encourage Council to endorse the review, we need to focus on these problems and deliver the fire service that the residents of Cornwall expect, and are paying for. The Cornwall Fire Service fails to meet the requirements of Council’s own Bylaws – there is extensive work to be done.”

Cornwall, ON – A 20-year-old man and a 21-year-old woman both of Cornwall were arrested on the 12th of August, 2013. It is alleged that during an argument with her 28-year-old ex-boyfriend the woman punched him in the head causing an injury that required medical attention. The man later threatened to harm him during a Facebook conversation. Police were contacted and an investigation ensued. During their investigation on the 12th of August, 2013 police located the man and the woman, both were subsequently charged, the man with Threats and the woman with Aggravated Assault. They were transported to police headquarters and held for a bail hearing. Their names were not released as it might identify the victim.

 

BREACHES

 

            Cornwall, ON – Shane Sarault, 21 of Cornwall was arrested on the 12th of August, 2013 and charged with breaching a Recognizance for being in the company of persons under the age of sixteen and breaching a Probation order for not keeping the peace. It is alleged that on the 11th of August, 2011 the man babysat someone under the age of sixteen for a short period of time. Police learned of the incident and an investigation ensued. During their investigation they located the man at his residence, took him into custody and charged him accordingly. He was transported to police headquarters and held for a bail hearing.

 

Cornwall, ON – Zachary McKinnon, 22 of Cornwall was arrested on the 13th of August, 2013 and charged with breaching an Undertaking for failing to notify a change of address and not keeping the peace. He was also charged with breaching a Probation order for having consumed alcohol and failing to keep the peace. It is alleged that while police were investigating a disturbance in the area of Fifth Street and Bedford Street police observed the man to be intoxicated and it was further learned he was of no fixed address. He was taken into custody and charged accordingly. He was transported to police headquarters and held for a bail hearing.

 

WARRANT

 

            Cornwall, ON – Pierre Godbout, 51 of Cornwall was arrested on the 13th of August, 2013 on the strength of a Warrant. It is alleged that the man was required to attend court on the 13th of December, 2012, however failed to attend and a warrant was issued for his arrest. On the 13th of August, 2013 while investigating an unrelated matter the man was located by police and taken into custody. He was transported to police headquarters and later released with a court date of the 12th of September, 2013.

The investigation revealed that a 24yr old male (Mitchell GEORGEOFF of Ottawa, On) was operating a 2005 Mazda when he failed to negotiate a curve in the roadway and went into the ditch. The male was located nearby and he was found to be operating a vehicle under the influence of alcohol.

He was arrested and faces charges of:

- Impaired Operation / Motor Vehicle / Alcohol
- Exceed 80 Milligrams Blood Alcohol Content / Motor Vehicle
- Theft Over $5,000 of a Motor Vehicle

He is scheduled to appear 27Aug13 in Cornwall court.
(North Dundas) – On 11Aug13, at approximately 2:00pm, SD&G OPP officers responded to a possible stolen vehicle on Van Camp Road, North Dundas Township.

The investigation revealed that two males had taken a 1999 Ford van without permission. Further investigation found the 47yr old male driver (Steve Saunders of North Dundas) was operating a vehicle under the influence of alcohol.

He was arrested and faces charges of:

- Impaired Operation / Motor Vehicle / Alcohol
- Exceed 80 Milligrams Blood Alcohol Content / Motor Vehicle
- Take Motor Vehicle without Consent

The 27yr old male passenger (Patrick HARPER of South Dundas) faces charges of:

- Take Motor Vehicle without Consent
- Breach of Probation

Both men are scheduled to appear 03Sept13 in Morrisburg court.
(North Glengarry) – On 11Aug13, at approximately 10:00pm, SD&G OPP officers had occasion to conduct a traffic stop on Skye Road, North Glengarry Township.

The stop revealed that the 47yr old male driver (Douglas LESLIE of Montreal, QC) was operating a vehicle under the influence of alcohol.

He was arrested and faces charges of:

- Impaired Operation / Motor Vehicle / Alcohol
- Exceed 80 Milligrams Blood Alcohol Content / Motor Vehicle

He is scheduled to appear 04Set13 in Alexandria court.
DOMESTIC INCIDENT

(South Dundas) – On 12Aug13, at approximately 8:30pm, SD&G OPP officers responded to a report of a domestic incident on Bourks Hill Road, South Dundas Township.

The investigation revealed that a female and her 42yr old common-law husband were involved in a verbal altercation that resulted in the male assaulting the female and another male in the residence.

He was arrested and faces charges of:

- Assault
- Overcoming Resistance to Commit indictable Offence
- Assault Cause Bodily Harm

He was held in custody pending an appearance in Cornwall court.

the Ottawa Police Service Sexual Assault & Child Abuse Section is seeking the public’s assistance in identifying four suspects wanted in relation to a sexual assault.

On Sunday, August 11, 2013 at approximately 5:00am, a young woman was sitting at the Blair Road Transit Station when she was approached by a group of males who offered her cash for sex. When the victim refused, she was led to a secluded area in the 1600 block of James Naismith Drive where she was robbed and sexually assaulted.

A nearby security guard was alerted to the incident when he heard screams and immediately contacted Ottawa Police.

The four suspects are described as being black males, approximately 18-20 years old,  6 feet tall (183cm) and short black hair. They spoke English and an unknown foreign language.

  • The first suspect was wearing a black t-shirt with stripes and black pants;
  • The second suspect was wearing a blue and white striped t-shirt, dark pants and a white ball cap;
  • The third suspect was wearing a dark colored long sleeve shirt with white lettering, dark pants and a white ball cap.
  • The fourth suspect was wearing a black t-shirt.

Cornwall Ontario Terry Fox Run – Sunday September 15, 2013 – Civic Complex 7:30 AM

run with terryThis year marks the 33rd Anniversary of the Terry Fox Run! Terry Fox, one of our greatest Canadian heroes, has left a legacy that has continued to grow and spread since he embarked on his Marathon of Hope on September 1, 1980.  Every year, people around the world are inspired to gather in his memory to raise money for cancer research through the Annual Terry Fox Run.  Since he first set out on his epic trek, over $600 million has been raised worldwide (Cornwall has raised over $320,000) for innovative cancer research in Terry’s name.

 

The Terry Fox Run will be held on Sunday, September 15th at the Cornwall Civic Complex between 7:30AM and Noon.  Everyone is invited to walk, bicycle, run or skate 1km to 10km along the bike path.  Participants can register inside the Civic Complex by making a personal donation of any amount, or by collecting pledges from friends, neighbours, family members and co-workers ahead of time and remitting their pledges at the Run Site.

 

Pledge forms can be picked up at BMO and RBC Banks, the Cornwall Public Library, Fitness Clubs, both LCBO locations, Pat’s Home Cookin’, the Aquatic Centre, the Benson Centre, Short Line Convenience & Video Store and Play It Again Sports.  Participants can also download and print their own pledge sheets or collect pledges online by visiting www.terryfox.org.

CFN - Local political buzz in Cornwall is whether all things are well in the Provincial Liberal riding association camp after none of the local Grit VIP’s were in attendance for Premier Kathleen Wynne’s visits to the River City including last candidate Mark A MacDonald or former MPP Jim Brownell.

CFN discovered and confirmed however that the Preme had time to breakfast with City Councilor Bernadette Clement who played a major role in Ms Wynne’s team construction and transformation.
.
The Bachelorette and Lawyer did not have an answer as to why the breakfast didn’t include any Liberal dignitaries and would not state if she was being groomed, considered for or would want to run in the upcoming Provincial election under the Wynne banner.   She confirmed word of the breakfast tete a tete at Monday night’s council meeting.
.
We contacted riding president James Borer regarding the visit to Cornwall.
.

I am happy to answer your questions to the best of my ability.  Unfortunately if further clarification is required it will need to be directed to the Premiere’s staff as I wasn’t personally involved in the visit.

As always the SDSG PLA appreciates CFN’s continued interest in the politics of our riding.

My answers follow below:

Why were there no local Liberal association members present?
1.  We were informed that because this was officially government rather than party business that the rules didn’t permit participation / attendance by Provincial Liberal members.
.
 Why wasn’t past candidate Mark A MacDonald invited or former MPP Jim Brownell?
.
2.  I unfortunately don’t have an answer to the decision taken to exclude the SDSG PLA from a breakfast meeting as we were unaware of it.  This would need to be directed to the Premiere’s staff.  I do know that it has upset a number of the members in the SDSG PLA.
.
Why did Ms Wynne have breakfast with Bernadette Clement at the exclusion of the local riding association executive?
.
3.  I haven’t discussed my continuing service in the role of elected President for the SDSG PLA with anyone to date.
.
I am dedicated to supporting a Provincial Government which stands for and respects the legitimacy of democracy.  To bypass properly elected representatives at any level shows a complete lack of respect for democracy and undermines any authority granted through fair and properly conducted elections.
Arrogance of this sort should never be tolerated in a truly democratic society.  
Operating in secrecy, outside of proper channels is not democracy but rather an abuse of power which is never accepted by people with the full rights of citizenship.
.
I am disturbed and quite frankly disappointed by the choice to not meet with the SDSG PLA while in our riding.  I will be seeking an explanation that makes sense and can justify such a deliberate act in order to answer to the members who elected me as their President.
.
We have heard rumblings that you are considering resigning your position?  Is there any truth to this?
 
Is there a rift between the local Liberal riding association and the Premier’s office?
4.  I am not aware of any rift between the Premiere and our riding.  I fully supported Premiere Wynne during the Leadership campaign as did a number of our delegation that voted in Toronto at the convention.  I am hopeful that this was an isolated incident based on an error made by her staff.
.
I look forward to dealing with it appropriately and moving forward as we prepare for the next general election.  Our PLA is dedicated to finding Nominees and electing the best Candidate to put forward for the next election so we can return SDSG to Liberal Leadership which respects the choice of those who elect them to Govern.

SD&G  was held for two terms by former Liberal MPP Jim Brownell.   Ms Clement, a two time councilor,  is considered a frontrunner as the next Liberal MPP candidate although her current council under Mayor Bob Kilger is under scrutiny with two Whistleblowing lawsuits and allegations of a coverup over the corruption at City Hall, and alleged scandals over the hiring of the Mayor’s son to the fire department.

Ottawa Police seeking rightful owner of found urn – August 14, 2013

CFN —The Ottawa Police Service is seeking the public’s assistance to identify the rightful owner of an urn discovered on July 31, 2013 by a passerby on the west side of Hog’s Back Park in a lightly wooded area. 

The urn is described as dark brown in color with a brass/gold colored trim just below lid (see picture). The dimensions are approximately 10” high with a diameter of 3.5” at the base and 6” at its widest point.

Inside the urn police located a plastic bag with the logo of Cercueils Magog Caskets, containing ashes, a small decorative framed plaque with the message “for always and no matter what” (see plaque), a light brown pillar candle, several rocks, several dry flowers along with a men’s ring.

The urn is believed to have been stolen as a result of a residential break and enter.

eilieen feetCFN – Oy, what is it with Coronation Street and propping up the gargantuan feet of actress Sue Cleaver who plays Eileen Grimshaw on Coronation Street?  What?  What is it!!   It’s as mysterious as the secret to how they put the caramel in the Cadbury chocolate bars or why there are no Jewish characters on the long running English soap?

I mean look at the picture.  Those tootsies are larger than Simon Gregson’s (Steve MacDonald’s) bloody head!    Do the producers get a lot of fan mail from large foot fetishists or are some of the writers getting freaky seeing as they are struggling plot wise of late?

Frankly as someone that’s been watching Corrie since the 70′s it’s getting a bit rank.   Pancreatic cancer, wheelchair mommies and their surrogate delivered babies, the who’s got the biggest boobs thing, racism in 2013, .   It’s getting a bit….boring.

Is Corrie in a rut? Is it the cast? The writers?

Coronation Street has been an institution now for generations and has always had its ups and downs, but frankly it’s becoming far too PC at every level.   The cheeky hidden “gay”  kitch to the show is now out of the closet and in your face.    The quirky characters becoming depressing; the older ones getting sick or dying and not having their voids filled.

What is going on in Corrieland?

The whole Stella and her family thing can go.    The Hailey dying of pancreatic cancer has some hope if they don’t drag it on too long as Roy can now get it on with Mary to form the weirdest yet somehow warmest couple ever on TV and that relationship should be a rich mine for the writing staff and actors.

All the villains on the show seem to have become saintly or lame.  Tracy Barlow?  Really actress Kate Ford seems lost as they have her looking more dumb than conniving.   Alison King as Carla (or Cruella)  is becoming a slightly drunken saint instead of the nasty biotch she plays best.   Actually a big part of the problem on Corrie is the female characters/arch types don’t play well right now.  Maybe they need to shake up the writing staff or take a step or two back and see what they’re doing with them.

I miss Fred Elliot (John Savident) Great Gail & Eileen scrap.


We need more character types.   When Corrie decided to bring in more young characters they lost a lot of character and quirkiness.

They need that back.  They need something.    While addicted loyal fans wither on and watch secretly I’m sure we all crave for some old fashioned Corrie fun.

Liz MacDonald coming back should help and hopefully Bill Roache and Michael La Vell don’t end up in prison (both are up on charges of playing with under aged girls) and add some stability to the show.  We need Jim MacDonald back punching just about anyone nearby!

We fans need more than big boobs and disease.  We need that Corrie magic back.  We need garden gnomes and Norris being afraid of vaginas.   We need Platt family Christmas explosions.   We need strange Dickenson characters salted in for bits of fun.  We need a new Jack & Vera.

Or I’m completely wrong and the big boob and diseased thingy is working.

One of my fave scenes of recent vintage.   Do you miss Jack & Vera too?


And please get rid of the chick in the wheelchair and her whole family too, except maybe her sister with the …..

guy lauzon pigeonsPerhaps you heard the Conservative party advertisement on our local radio stations, If not (and I’d be very surprised if you didn’t here in Lauzonville) then you have heard or seen Canada’s Economic Action Plan ‘adds’ ad nauseam on road signs, on radio and especially on TV. I hope that people are intelligent enough to realize that Harper is a one pony show fixated on pipelines and the Alberta tar sands. In the ‘add’ (propaganda) on our local radio stations the CPC are again talking about the importance of the tar sands and the ‘government of Harper’ being the great custodian of the environment (Environmental Stuart) by protecting it and having scientists make sure that no harm is done. They also state that any harm done will be the fault and sole responsibility of the companies doing the extracting and moving the bitumin and not passed on to taxpayers.
.
Well, as usual we are being fed a bunch of lies as the CPC have been bilging us taxpayers hundreds of millions of dollars (our tax dollars) promoting their sole obsession in the tar sands and pipelines to move it.
.
Is this the only industry in Canada? Are all the other industries dependent and tied in solely to the tar sands?
Is it true that Canadians will not be on the hook for an ecological disaster? Just look at the Lac Megantic disaster for an answer. The company MMA is being shut down and the province and federal government will no doubt pay the bill, over what they have already promised.
.
So people, it’s time that we tell our MP’s that enough is enough of the propaganda adds and junk mail that we are receiving. Maybe the CPC should look for other Canadian industries to support and brag about.
Canada used to take pride in our forestry and fishing industry as well as many other mining industries. Let’s not forget our farmers who feed us and the world. Canada also has been a leader in the high tech industries such as cell phones and computers and let’s not forget the Canada Arm that has put Canada in the world spotlight high above us here on terra firma.  But somehow all the touchy feely advertisements with mothers and children romping in pristine Canadian environments, in the CPC’s mentality, owe their existence to pipelines and tar sands.

weedCFN – The Ottawa Police Service Drug Unit, in partnership with the Ontario Provincial Police (OPP), Ottawa Fire Services and the Canada Border Services Agency, recently completed a three month drug project dubbed project “Power Plant”.

 

The drug project specifically targeted marihuana grow operations and marihuana traffickers in the community.  Numerous search warrants were executed in Ottawa and surrounding OPP jurisdictions over the course of the Project.

 

“Project Power Plant proved to be very successful,” noted Staff Sergeant Mike Laviolette, Ottawa Police Drug Unit.  “It has significantly disrupted the illicit production of cannabis marihuana in the Ottawa region.”

 

During the joint police operation, police seized in excess of $6.8 million dollars worth of marihuana, and over $35,635 in currency.   A total of 12 Controlled Drugs and Substances Act search warrants were executed, eight of which were hydro bypasses increasing the danger of fire thus posing a significant threat to the community.

 

A total of 20 persons are charged with 79 Criminal Code and drug offences, and 33 charges were laid under the Ontario Fire Code.

 

Additionally a number of weapons were seized including a 12 gauge shotgun, a crossbow, ammunition and a bullet proof vest.

 

The following people are charged with various criminal offences including:  Production of Marihuana – section 7(1) CDSA; Possession for the purpose schedule II marihuana – section 5(2) CDSA; Proceeds of crime over – section 355(a) CCC; and Theft of electricity – section 326(1)(a) CCC.

dr evil 2CFN – Is history repeating itself? I would bet Prime Minister Harper certainly hopes it doesn’t, at least not while he is the Prime Minister.

Back in February of 2004, then Auditor General Sheila Fraser brought in a report that kicked off what would eventually become known as the sponsorship scandal. The negative press coverage this generated for the Liberals led to first a minority Liberal government in 2005, which was followed by a Conservative minority government in February 2006. Much of the Conservative success under Harper was due to the public perception that the Liberal Party misused taxpayer’s dollars and that it had become scandal plagued.

This view of the Liberal Party didn’t happen overnight. It took time to develop; as a matter of fact it took 21 months from Fraser’s report until the Paul Martin minority government of 2005. Throughout that time period there was a steady stream of negative stories that were just sensational enough that they caught the attention of the public in a way that most political stories never do.

Harper has to be concerned that the on-going Senate scandal doesn’t cause history to repeat itself. Twenty-one months is a long time in politics, but under his leadership the Conservatives were able to keep Liberal scandals front and center and on the minds of the voters.

This time around the names are different, there are also different allegations of spending abuse, but the public appears to be as equally fascinated with this Senate scandal as they were with the sponsorship scandal from 2004-2006.

Paul Martin was faced with the revelations of not only Sheila Fraser, but the subsequent Gomery inquiry, especially the first Gomery report in 2005. Harper doesn’t have to face anything as damning, but he has had two audits by Deloitte on his Conservative appointees to the Senate (Wallin and Duffy) and fortunately for the Prime Minister one on Liberal senator Mac Harb, all of which have served to keep both the media and the public focused on this issue.

The ongoing RCMP investigation into the Nigel Wright cheque that was given to Senator Duffy plus the potential for further RCMP involvement into allegations  around Senator Wallin, means this story and the Senate scandal have the potential to drag on for many more months. All of which spells negative coverage for the Prime Minister and the Conservative Party.

If charges are laid and court proceedings begin, most of this will occur over the next year or longer. This has the potential to drag the negative coverage out from February 2013 to sometime in late 2014 if not 2015, the next election year. In other words the Senate scandal has the potential to unfold over a somewhat similar time frame to the sponsorship scandal.

The sponsorship scandal helped to cement in the public’s mind that Harper wanted to change the way things were done in Ottawa and that he wanted to do things differently. This is similar to what the present Liberal leader is promising to do and Mulcair is also trying to convey a similar message to the voters. It remains to be seen if either of them can be as successful as Harper was back in 2004-2006.

How Harper handles himself and this issue may just possibly determine the fate of his government when the next election campaign begins. A day is a long time in politics, never mind 21 months or a couple of years, but with this file Harper can’t think short term, he has to keep his eye on the next election as voters have shown him that they can have long memories.

Former Clerk Denise Labelle-Gelinas had this on her Facebook status.    During the election there were other allegations of City Staff acting on behalf of the mayor on City Time as well.

The city is still refusing to disclose to the public what this messy waste of tax dollars is about. They are not being accountable nor replying to emails or answering media calls in a timely fashion.

It appears that the replacements of Paul Fitzpatrick & our clerk by Norm Levac and Helen Finn may simply be a change of the face, but not a change of how things have been done.

And what of the Mayor himself?  Would someone like to check his attendance record during this and last term at committee meetings for the city?

While he recently had time to sit in on a new Waterfront condo development (on the former Domtar lands) and personally walked through with inspectors for the Truffles Burger Bar patio application (which was expedited) has the Mayor himself been giving the city value for the time he himself has spent?   Does breakfast at Napoleon’s count as time spent on the job?

Should every city paid employee or contractor be monitored?   The truth needs to come out about not only what happened to the five, but more importantly the process.   Were they arbitrarily or unfairly fired?  Were they treated differently than other staff?   The public deserve answers.

Sexual Abuse in North Dundas – Cornwall Ontario Police Blotter Friday August 16, 2013 – OPP SIU

Cornwall, ON – A 44-year-old Cornwall man was arrested on the 15th of August, 2013 and charged with Assault. It is alleged that on the 15th of August, 2013 while in his yard the man was involved in an argument with his 32-year-old common law wife and during the argument held her against the fence. Police were later contacted and an investigation ensued. During their investigation the man was contacted by police and attended police headquarters to deal with the matter. He was subsequently taken into custody, charged accordingly then released with a court date of the 10th of September, 2013. His name was not released as it might identify the victim.

 

 

Cornwall, ON – A 20-year-old Cornwall woman was arrested on the 16th of August, 2013 and charged with Mischief Under $5000. It is alleged that on the 16th of August, 2013 the intoxicated woman was involved in an argument with her 22-year-old common law husband and during the argument threw a remote control causing damage to a television. Police were contacted and an Investigation ensued. During their investigation the woman was taken into custody, charged accordingly and later released with a court date of the 10th of September, 2013. The woman’s name was not released as it might identify the victim in this matter.

 

 

ASSAULT CAUSE BODILY HARM AND BREACH PROBATION

 

                Cornwall, ON – A 17-year-old Cornwall youth was arrested on the 16th of August, 2013 and charged with Assault Cause Bodily Harm and breach of Probation for failing to keep the peace. It is alleged that on the 15th of August, 2013 the youth attended the Optimist Skate Park and exchanged words with a 14-year-old youth. During the exchange the 17-year-old youth punched and kicked the 14-year-old youth causing injuries. As a result the14-tear-old youth attended the hospital for medical attention. Police were contacted and an investigation ensued. During their investigation on the 16th of August, 2013 the17-year-old youth was located at his residence, taken into custody and charged accordingly. He was then released with a future court date. His name was not released as per provisions of The Youth Criminal Justice Act.

WARRANT

 

Cornwall, ON – Ronald St-Amour, 53 of Ottawa was arrested on the 14th of August, 2013 on the strength of a Warrant. It is alleged that on the 24th of January, 2012 he was scheduled to attend court, however failed to attend. On the 14thof August, 2013 while at the Cornwall Court House the man was spotted by police and taken into custody then later released with a court date of the26th of September, 2013.

 

Cornwall, ON – Lindsay Dowling, 20 of Cornwall was arrested on the 14th of August, 2013 on the strength of a Warrant. It is alleged that the woman was scheduled to attend court on the 13th of August, 2013, however failed to do so. On the 14th of August, 2013 the woman attended police headquarters and turned herself in. She was taken into custody and later released with a court date of the 26th of September, 2013.

 

DOMESTIC BREACHES

 

Cornwall, ON – A 52-year-old Cornwall man was arrested on the 14th of August, 2013 and charged with two counts of breaching his Recognizance by being within 100meters of a certain residence and for having consumed alcohol. It is alleged that on the 14th of August 2013 police spotted the man walking near the residence and upon speaking with him detected a smell of alcohol. He was subsequently taken into custody, transported to police headquarters and held for a bail hearing. His name was not released as it might identify the victim.

(NORTH DUNDAS TOWNSHIP, ON) – On Wednesday August 14, 2013, members of the Ontario Provincial Police (OPP) Child Sexual Exploitation Unit, Technological Crime Unit and the Stormont, Dundas and Glengarry Detachment arrested a 36 year old North Dundas Township man following a child sexual abuse investigation.

Police began their investigation approximately two weeks ago after receiving a report the suspect had sexual contact with a 14 year-old child.  On Wednesday August 14, 2013, police executed a search warrant at his residence in North Dundas Township and seized 17 computers, related computer equipment, audio/video recording equipment and a quantity of marihuana.

Daniel Robert ADAMS, 36 years old, of North Dundas Township is charged with one count of Invitation to Sexual Touching, two counts of Possession of Child Pornography, one count of Making Sexually Explicit Material Available to a Child, one count of Possession of a Controlled Substance and one count of Possession of a Controlled Substance for the Purpose of Trafficking.  The investigation is continuing and further charges are pending.  The accused will appear for a remand hearing on August 19, 2013 in the Ontario Court of Justice in Cornwall, Ontario.
The OPP is asking anyone who may have information pertaining to the accused or this investigation to contact the OPP Child Sexual Exploitation Unit at (705) 330-3240.

(SD&G) – SD&G OPP would like to remind you that this is the time of year that a certain type of criminal becomes active. They usually work with three or four people in a paving or residential maintenance crew.

They could be from another area of the province or another country. They will attend a residence and do a good job for a fair price, then once the word has spread that they are a reputable group, the less than professional work comes into play.

These criminals target older and vulnerable people. They are pushy and will go to great lengths to secure a job and payment before the work is completed. They use tactics that make people feel that they have to have the maintenance done, and on completion the home owner is far from satisfied.

The SD&G OPP wants to advise our residents that nothing has to be done under pressure. Always ask for a list of other satisfied customers in the area. They should be able to provide this along with a written estimate for the job you want completed. Get more than one estimate.

If you are not sure, consult a family member or close friend about the work and the price that is being suggested. If you feel the people attending your property are trying to intimidate you and are putting pressure on you, ask them to leave. Write down any information you may observe about their description, number of people, and the vehicles that they are using, especially a licence plate. Call 888-310-1122 to report them to the OPP immediately.

There are many excellent, reputable contractors in our area. Make sure you make an informed choice before allowing anyone to do work for you.

Remember, you are the home owner and you decide what work you want done and you choose the contractor to complete it.

(South Glengarry) – On 13Aug13, at approximately 9:00am, SD&G OPP officers responded to a report of a domestic incident on Harkness Drive, South Glengarry Township.

The investigation revealed that a female and her 19yr old boyfriend were involved in a verbal altercation that resulted in the male assaulting the female.

The male (from South Stormont) was arrested and faces a charge of:

SIU Concludes Injury Investigation in Toronto

Case Number: 13-TCI-122

Mississauga (15 August, 2013) — The Director of the Special Investigations Unit (SIU), Ian Scott, has concluded that there are no reasonable grounds to charge a Toronto Police Service officer with a criminal offence in relation to the injuries sustained by 35-year-old Karl Andrus in August of 2012. This matter did not come to the attention of the SIU until May 15, 2013 when Mr. Andrus’ lawyer contacted the Unit.

The SIU assigned three investigators and two forensic investigators to probe the circumstances of this incident. As part of the investigation, 10 witness officers and four civilian witnesses were interviewed. As well, several videos were reviewed – imagery was captured on two Sheraton Centre Hotel CCTV surveillance videos, and Mr. Andrus took a video of the incident that was uploaded onto YouTube. The subject officer supplied a copy of his duty notes, but declined to be interviewed as is his legal right.

The SIU investigation found that the following events took place on August 29, 2012:
• In the evening hours, the subject officer and other officers were dispatched to the Sheraton Centre Hotel in response to a guest who had allegedly assaulted one of the hotel’s security staff. Officers arrested the alleged assaulter by taking him to the ground. The arrestee’s father, who began screaming after his son’s arrest, was arrested for causing a disturbance. He immediately started to suffer some kind of medical distress related to his breathing and an ambulance was called. Two female family members of the two men then became upset and attempted to intervene.
• Mr. Andrus was a hotel guest who happened to walk into this arrest scene near the hotel elevators and lobby.  He began video recording the events on his cellphone.  After about two minutes of recording, he was approached by the subject officer and told that he had filmed enough and was asked to step back to the other side of the elevators. Mr. Andrus remained where he was and continued recording. The subject officer instructed another officer to move Mr. Andrus. The officer faced Mr. Andrus and forcefully said, “I’m cautioning you now for obstruct. Move back. Get back. Or I’m going to arrest you.”  He advanced toward Mr. Andrus causing him to back up toward the elevators. The officer then turned away and Mr. Andrus immediately moved back to the spot where he originally stood. This time, the subject officer approached Mr. Andrus and told him to back up. Mr. Andrus backed up while telling the subject officer he was a guest at the hotel and asserting his right to stand where he previously stood to continue recording. On the hotel CCTV video, he can be seen raising his left arm in an upper cut motion in the direction of the subject officer’s upper chest or head area. Immediately thereafter, approximately four officers can be seen subduing Mr. Andrus, taking him to the ground and handcuffing his wrists behind his body. Mr. Andrus was arrested for obstructing the police and assaulting a police officer.
• A later medical examination diagnosed a right rib fracture.

Director Scott said, “The central question in this matter is whether the subject officer had the lawful authority to insist that Mr. Andrus move from the position where he was standing and video recording to a position on the other side of the elevators. In my view, he had the authority to do so. Police officers pursuant to the Police Services Act have the statutory duty to preserve the peace. Further, they have the powers and duties ascribed to a constable at common law. In order to be acting lawfully, an officer must be acting in the course of his or her duties and the conduct in question must amount to a justifiable use of police powers associated with that duty. Here, the police were dispatched to a call where a family member had been arrested due to an alleged assault against a hotel security staff member, causing the remaining three family members to become very upset. The father then lapsed into medical distress. The two remaining female family members became even more upset and would not stay away from the two men under arrest. This chaotic situation was unfolding in an area circumscribed by elevators with numerous hotel guests coming and going.”

Director Scott continued, “In my view, the involved officers had the authority to insist that any onlookers remain a certain distance from this disorderly situation until calm prevailed. Further, the involved officers had to provide adequate space for paramedics to attend to the family member undergoing medical distress. Accordingly, the subject officer had the lawful authority to demand that Mr. Andrus step away from the arrest scene. Therefore, when Mr. Andrus raised his arm in an aggressive manner towards the subject officer who was lawfully removing Mr. Andrus from the arrest scene, the officer had the lawful authority to arrest him for assaulting a peace officer. As well, other officers had the authority to assist in that arrest. Given Mr. Andrus’ resistance, I am of the view that the involved officers did not use excessive force in effecting this lawful arrest. Accordingly, I have no reasonable grounds to believe that the subject officer committed a criminal offence.”

Director Scott added, “I am mindful of the fact that Mr. Andrus takes the view that he was only video recording police involvement in these arrests, and that he had the right to remain where he was to continue recording. I agree with him that he had the right to record this police activity. There is no law that I am aware of that prohibits citizens from recording police activity in public areas. However, the right to record police activity should not be confused with the authority of the police to require citizens to comply with lawful commands to control a disorderly situation. Here, in my view, the subject officer was attempting to control a difficult situation, and had the lawful authority to require Mr. Andrus to step away from the arrest scene whether or not he was video-recording the involved officers’ actions.”

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.
