Kilger Campaign Manager & Chair of Cornwall Police Board, Pat Finucan Thinks My Wrongful Arrest Is Funny by Jamie Gilcig

finucan

CORNWALL Ontario – I was at Riverdale Terrace for the first time tonight.    Stunning facility for those to retire to; but it was former St. Lawrence College Dean, failed Provincial Liberal nomination candidate,  and Kilger campaign manager Pat Finucan that marred the evening.

It was stunning and shocking.  Sadly it was no surprise.  Mr. Finucan is usually the epitome of reserved intelligence.  A true gentleman; but today his veneer fell as he actually laughed about my criminal charges and the fact that the Crown has refused to drop them in spite of a production order from Bell categorically proving that I didn’t make any calls as per the claims in the disclosure.

I was charged with making threatening phone calls, not just once, but a second time after being warned back in February of 2014.   The times, dates, duration, and from which number were in the disclosure.   I was put in a cell, charged, finger printed and smeared in the police blotter and then by multiple media outlets.

Why does this matter in relation to Mr. Finucan?  Because besides being the Mayor’s campaign manager he is the chair of Cornwall’s police board of which Mayor Kilger also sits.

That also means that Mr. Finucan plays a key role in whether sitting Chief Dan Parkinson gets a new contract.  Ditto for Deputy Chief Danny Aikman.

During a friendly chat I asked Mr. Finucan about what he thought about my charges not being dropped by the crown and he feigned a lack of knowledge about the entire incident which I found incredulous.

I asked Pat how he’d feel if he’d been locked up for the first time, fingerprinted etc.   He actually laughed and thought it was funny.

I was stunned.  I shared that having experienced this I didn’t really think that it was funny.    He explained the role of the Police board to the amazement of myself and another council candidate in the conversation.

He then asked the candidate what they’d do about it if  they were on council which was a boggling question as city councilors do not have the same impact on policing that Chairs of the Police Board do.

As someone that had lived on this planet for 49 years without ever being charged with any crime; never mind be booked, or politically smeared in the police blotter, it was a shocking experience and frankly a frightening one.  Having to empty pockets, lean against a wall and be patted down, sit in a very odd plastic stoolish kind of chair….not to mention wondering about the ramifications including care of a very sick old dog.

I have sent an email to all of the MPP’s in this province which resulted in a letter sent to the Attorney General, Madeleine Meilleur by our MPP Jim McDonell.

One month later and that letter has not been answered.

We now are asking people to contact the Attorney General’s office in Toronto and to sign the petition below.

mcdonell letter to AG

The AG has been contacted by a lot of people; but the crown is still refusing to drop my charges and investigate what exactly has occurred here in Cornwall.   And until my charges are dropped or heard in court (which can take up to one year to occur) the bad guys can’t be held accountable.

I’m again appealing to our viewers to contact the AG and ask that her offices investigate this embarrassing travesty of justice of our Ontario Criminal and Legal system and investigate this and have my charges dropped immediately so the police can go after those that made false claims against myself.

Letter to the Editor – Tim Bird of Oshawa Frustrated After Million Dollar Fire – Sept 26, 2014

LTE UPlease accept this as a letter to the editor, or as a news story lead:

I write this letter out of pure frustration with Oshawa City Hall.  For 7 years our community has been “boring” our City officials with warnings that their ridiculous approach to the student housing issue, would spawn some catastrophic event.

Well on Sept 24, it finally happened.  There have been dozens of close calls, but this time two student lodging houses burnt, causing over $1,000,000 in damages.  As a community, we are only dumb lucky that no one was injured or killed.

In our quest to turn around their mindless approach, we have discovered and shared the following with all City officials, mayors and councillors:

- In 2009 The Supreme Court of Canada ruled that these houses were illegal.  But the City decided to give them licenses to operate anyway.
- We attained copies of some license applications, which showed the City had awarded licenses to houses which failed the fire inspection.
- In 2012 we shared this evidence with this council and with City officials.
In return for our concerns of the young people in these houses, we have been met with arrogance, indifference and we were even laughed at by one councillor.  That councillor has been uncharacteristically quiet on Facebook, since this fire occurred.
Best Regards
Tim Bird

SIU Concludes Investigation into Hamilton Custody Injury

Case Number: 14-OCI-062

Mississauga (25 September, 2014) — The Director of the Special Investigations Unit (SIU), Tony Loparco, has concluded that there are no reasonable grounds to charge any Hamilton Police Service (HPS) officer with a criminal offence in relation to the injuries sustained by a 27-year-old man in March of this year.

The SIU assigned six investigators and two forensic investigators to probe the circumstances of this incident. As part of the investigation, four witness officers and three civilian witnesses were interviewed. Two subject officers were designated; both consented to an interview with the SIU and provided a copy of their duty notes.

The SIU investigation found that the following events took place on Saturday, March 8, 2014:

  • Shortly before 10:00 p.m., the man was reported to have stabbed several people in various units of an apartment building on Melvin Avenue in Hamilton with a knife.
  • The HPS was contacted and officers responded to the scene.
  • By then, the man had exited the apartment building and was running alongside the fence that divides 221 Melvin Avenue from 215 Melvin Avenue.  He scaled the fence and made his way onto the rear lot of 215 Melvin Avenue, which housed a pizza and sandwich store.
  • The officers surrounded the man and ordered him to drop the knife, but he refused to comply, instead confronting one of the subject officers with the knife still in hand.
  • The subject officer discharged his conducted energy weapon (CEW) at the man.  The discharge seemed to have little to no effect.  The man pulled the CEW prongs from his body and retreated to the rear of the pizza and sandwich store, where he climbed a set of stairs leading to a second floor patio of the building.  He continued to refuse all commands to drop the knife and instead started throwing objects from the patio at the officers below.
  • Meanwhile, officers continued to respond to the scene, including the second subject officer who was the senior officer on scene.
  • The first subject officer briefed the second subject officer and relinquished command of the police operation to him.
  • In the meantime, the man had made his way off the balcony onto a thin sloping ledge alongside the western wall of the pizza and sandwich shop.  He fell from the ledge onto the asphalt driveway below, fracturing his spine and ankle.
  • The man was still in possession of the knife and surrounded by officers, who continued to maintain their distance.   He hopped for a distance toward Melvin Avenue, but lost his footing and fell forward.  As he stood up, the second subject officer discharged his CEW.  The discharge struck the man causing him to fall backwards, but he was soon able to remove the probes from his body.
  • The knife still in his right hand, the man waved it at the officers, prompting the second subject officer to fire his CEW a second time.  The probes missed their target.
  • Around this time, another officer attempted to pepper spray the man, but that too proved ineffective.
  • Emergency Response Unit (ERU) officers arrived on scene at around 10:10 p. m. and assumed control of the situation.  By this time, the man had made his way to the front of the business located at 211 Melvin Avenue, directly adjacent to and west of the pizza and sandwich store.
  • ERU officers repeatedly ordered the man to drop the knife.  It was decided that they would use an Anti-Riot Weapon Enfield (ARWEN) in an effort to disarm him.  Four rubber bullets fired from the ARWEN at relatively close range proved ineffective in disarming the man, who was still on the ground holding the knife.  Another ERU officer deployed his CEW twice at the man.  The probes met their target and the officer initiated the electric charge, but again the man was unaffected on either occasion.
  • A fifth ARWEN round fired at the man caused him to drop the knife.  With that, the ERU officers moved toward the man.  The man managed to retrieve the knife as the officers moved in on him. This time the officers overpowered him, forcibly removing the knife from the man.

Director Loparco stated, “The involved officers had every reason to believe that the man constituted a real and present danger.  He was holding a knife, its blade measuring about 20 centimetres in length, and waving it at the officers. The officers knew he had just stabbed several people.  They tried to communicate with the man but he was not receptive.  With respect to the various CEW deployments, it bears noting that the man seemed largely impervious to the incapacitating effects of the weapon.  On a couple of occasions, he appears to have simply pulled the CEW probes from his body while the weapon was discharging.  This, in my view, is powerful evidence that the discharges did not amount to excessive force.  But more than that, it is also clear that resort to the weapon was at all times reasonable in the circumstances.  As for the discharges by the two subject officers, these were more in the nature of self-defence as the man advanced with the knife to within close proximity of the officers.  They were entitled, in my view, to meet the threat posed by the man by discharging their CEWs.  As for the CEW discharges by the ERU, these were done predominantly with a view to securing the man’s arrest.  Much the same can be said for the use of the pepper spray and the ARWEN discharges.  Finally, it bears noting that none of the officers present at the scene caused the man to break his spine and ankle.  These fractures occurred when he, unaided and unprompted by any of the officers, jumped or fell from the second floor exterior ledge of the building at 215 Melvin Avenue.”

Director Loparco concluded, “In the final analysis, whether pursuant to section 25 of the Criminal Code (authorizing the use of force in the execution of an officer’s duty) or section 34 of the Code (prescribing the limits of defensive force), the force in question was legally justified and there are therefore no grounds to proceed with charges in this case.”

The SIU is an arm’s length agency that investigates reports involving police where there has been death, serious injury or allegations of sexual assault. Under the Police Services Act, the Director of the SIU must

  • consider whether an officer has committed a criminal offence  in connection with the incident under investigation
  • depending on the evidence, lay a criminal charge against the officer if appropriate or close the file without any charges being laid
  • report the results of any investigations to the Attorney General.

Election Gets Uglier as South Stormont Chamber of Commerce Hijacked by Candidates

$

tammy hart april 2014CFN- The election in South Stormont took an ugly turn as the South Stormont Chamber of Commerce has donna primeaubeen officially hijacked.    The chamber, having been resuscitated from death in the last year, took a downward turn after sitting President Donna Primeau chose to not have the scheduled AGM.

According to Chamber bylaws at the end of the year an AGM is held where an entire new board is elected.

Ms Primeau, who is running for council herself, not only has refused to do that; but edged out two board members illegally and has refused to issue minutes and other pertinent details.

LINK TO September 12 story.

Ms Primeau herself also may not qualify to be a member much longer as she may have sold her business and has already taken employment.

Oddly enough an election event was announced Friday night as being sponsored by the chamber; but questions have to be answered as the Chamber may not have the right to spend monies or take any actions until an official AGM has taken place.   Likewise privileged information has been shared by Ms Primeau and other candidates before all of the candidates were notified.

Hi all,

I am told from Donna Primo (President of the South Stormont Chamber of Commerce) there will be an all candidates night held by their Chamber.

A date has not been determined.

I will only attend The South Stormont Chamber of Commerce all candidate night.

Tammy Smile
That email was from 11 days ago on September 16th.  How did the Deputy Mayor have knowledge of an event that Chamber members weren’t even aware of including some on the board of directors of the chamber as CFN has learned?
The normal procedure; if the board was in good standing, would be for a meeting to be held by the executive with any members that are candidates recusing themselves.   This clearly has not occurred.  Likewise some candidates clearly knew of what was happening, while many clearly had no information.
And those lines are also very clear as they fall into the war that the Deputy Mayor is waging against incumbent mayor Bryan McGillis.
To date only one All Candidates Debate has been called in the township on Tuesday October 7th at 7 PM at The Marina Restaurant in Long Sault hosted by The South Stormont News and recorded on video for the public to view afterwards.

Facebook Group Illegally Using Township Logo for Ugly South Stormont Election

sept 26 FACEBOOK south stormont candidates group CURRIER likes HARTCFN – A facebook group administered by a gentleman that has one group taken down for hate symbols and been suspended for copyright infringements, defacement of the poppy,  as well as being a convicted criminal has now been caught using the Township’s logo illegally to make the page look as though it has the township’s seal of approval.

Township clerk Loriann Harbers confirmed that South Stormont will be taking “appropriate action” to remedy the use of the township’s logo.

Ironically the Deputy Mayor of South Stormont herself, Tammy Hart is a member of the group and participates in it as well as candidates Richard Currier and Mike Proulx.

Councilor Richard Waldroff appeared to rebut some of the alleged mistruths being spouted by Mr. Currier and his supporters.

I would like to clarify an item I found in circulated material recently

BIO Pellet
This project was approved prior to 2010; the purchase was accompanied by a $76,000 deposit. The company was not able to acquire the funding needed to complete the build. After a lengthy time period the township foreclosed on the outstanding mortgages and reclaimed the property. As a result of this action an expense of $22,783.59 was incurred for legal and taxes leaving the township with $53,216 from the deposited monies, this was transferred to South Stormont Township Municipal Land Development account for future endeavours. The losses incurred by the Township on this transaction was the time, and energy of the Council and Staff who were attempting to bring something good to the township. During this time I know of no other inquires to purchase the property in question.
(Source December 11, 2013 Finance report F-20-2013 to council)

This morning Mr. Currier made several defamatory comments about our coverage of council meetings.

..to the Deputy Mayor and tried his intimidation techniques, by putting it in her face. Deputy Mayor Hart, loudly stated “get lost, get lost, get lost”. He smirked and went back to his corner. The Mayor and council witnessed this, and did nothing. This has happened on numerous occasions, in South Stormont. Mayor McGillis, Councilliors Woods, Waldrof and Brownlee, continue to allow this intimidation.

Mr. Currier perhaps isn’t aware that it’s common for media to question elected officials before and after an event.    In this case I was asking the Deputy Mayor about the grave allegations that she had removed a stack of The South Stormont News from a restaurant complaining that it was bashing her.  The papers included four election ads and is under investigation by the OPP.

It should be noted that Mr. Currier was to my back so it would bewildering to imagine how he could possibly see my face which was not smirking or otherwise.    Also as was noted in the group, surely if Mr. Currier feared for Ms Hart’s safety he would not have simply sat in his chair?  In the video Ms Hart appears to be turning her gaze to him.   There was a desk between the two of us and a good six feet of space.  The other elected officials and staff may not have said anything because nothing improper was done.  I walked up to councilor Brownlee and did an interview with him before the same meeting started as well.

Mr. Currier’s platform and advertising is pinned to the top of the Boycott South Stormont News facebook page as well.

In politics not every question an official gets is one they like.  Politicians are held to standards and the public does have a right to answers.  That is the job of media; to try and get those answers.

In this case the newspapers in question were in a restaurant that the All Candidates debate is to take place on Tuesday October 7 at 7 PM and the Deputy Mayor, who has stated publicly and repeatedly that she wants to “get rid of that paper” would not be interested in taking a stack of papers to read?

The group is mostly populated by members of the group that had been taken down for Hate symbols as well as another group that has now gone underground; the Cornwall n area X Files, which also was hit for trademark infringement and for defacing the poppy which Mr. Currier, who is retired military supported as did honorary Lt Col of the Glens and former Liberal MPP Jim Brownell who was a member of the group, and when asked about the incident stated that he wasn’t “his brother’s keeper”.

dockery poppy joking MOD

The defacement of the poppy was called:

It is a first. I have never seen such a blatant defacement of our sacred symbol and believe that if other Canadians could see it, they’d be as outraged as I am,” says Bill Maxwell, who is secretary of the Legion’s Poppy and Remembrance Committee.

They say politics make strange bedfellows.  The hatred being exhibited by this motley crew have Deputy Mayor Hart, who erected a bill board in the 2006 election against then Mayor Jim Bancroft, now endorsing him, and the twinning of Hart, a hard core Conservative with long time Liberal Brownell.

The election is on October 27, 2014.

Frost Flees Library Debate – I Rocked It Even Though TC Media Won’t Cover it by Jamie Gilcig

jg2CORNWALL Ontario – It is a popularity contest, isn’t it?

I had the funniest chat with a former mayor of Cornwall at the Library event Monday night.    I had previously watched this gentleman have a slap fight with Mayor Kilger at a council meeting.  Clearly he would not support the mayor;but clearly he was not a fan of Mr. O’Shaughnessy; most likely for partisan political reasons.

I joked with him that he had a conundrum as there was only one other alternative.

It was a weird and surreal night.  Of course with David Rawnsley as moderator things would be a bit astral.    Mr. Rawnsley did a first rate job too.

Council candidate Brock Frost fled the debate running down a library row through books that I doubt he’d ever read.  He appeared fine after the debate saying that he had blacked out.  Butterflies?  Bad reaction to ….?    Does Justin Towndale exist?  I jest, but the candidate still hasn’t shown his face at an event yet.

It was a motley mix at the library; part high school like running for class president; part running for issues.   You could see jitters like Davey Bedard losing it or Greg Kielec fumbling as he filtered his message while gerrymandering some truths.

There were some low points; David Murphy totally fabricating a reality and clearly offering little to no substance; but sounding great; sugar coating a council record that frankly should be investigated by police and that he being a “rookie” is no excuse for.

I won’t even mention the odd weirdness that was Glen Grant’s speech.  The crowd didn’t respond much either.  Poor Pat Clarke ate up nearly all of his three minutes sharing his various groups and boards that he’s on (all that boycott this newspaper too!)

Some prepared statements; some ad-libbed.  Some interesting speeches of note; Heather Megill, Mary Ann Hug, Denis Carr, and Claude McIntosh had the funniest line of the night taking a shot at postal workers.   Some knew about arts and some didn’t.  Sadly some of those that didn’t tried to bluff it and clanged such as Mr. Murphy and Councilor Grant.

Some focused on other issues pointing out problems at City Hall as Mark A MacDonald, Roland Besner, and Greg Kielic did.

The crowd was larger than expected at our beautiful library that I shared should become an even more beautiful downtown Art Centre as we have another library two blocks away which drew more support from the Library crowd than I expected.

And now for what many have been waiting for.  The excerpts.   I only voice recorded as I didn’t want to stand up with a video camera while a candidate and couldn’t get someone to cover last night.

Some council candidate excerpts

Holy Gilles Latour! Over $200K in Fraud & Collection Allegations for Wealth Management Team Cornwall Former Prez by Jamie Gilcig

Former Liberal MPP for the riding Jim Brownell

CORNWALL Ontario – Former President of Team Cornwall Gilles Latour (Latour Wealth Management) made his first appearance at

Latour good friend Cornwall Mayor Bob Kilger

Latour good friend Cornwall Mayor Bob Kilger

the courthouse on his Fraud arrest.

CFN has learned that the count so far is over $200,000 in fraud allegations and counting according to the buzz around Cornwall.

Mr. Latour was Cornwall Mayor Bob Kilger’s bag man for the last municipal election.

As well reports have come in of allegations of firms having to issue suit to Mr. Latour over non payment for services; with at least one party stating that they were taking him to court for an amount under $5,000.

When I started following up on his debt he told us he thought it was paid and he’d look into it.  Next correspondence he advised that he fired the staff member who was responsible for paying the bills because he found out SHE was stealing from HIM and it was a LOT of money (I had heard of stories like this, how awful!!).  He was going to have to take his books to his accountant to get it all sorted out.  Next followup … he was shocked it wasn’t paid, fired another staff member for not paying this (at this point I knew something was very wrong, nobody does that … in hindsight he was probably spinning out of control and forgot who he told what to).

He advised us he had to find a new accountant as well … he would pay us once he got it all sorted out.  Knowing at this point something was “off”, I passed the file over to my husband expressing my concerns.  I wanted him to now followup with Gilles as he is the one who has the relationship with him.  After many “no return calls” my husband threatened legal action …

THEN we heard from him.  He said he was at the hospital with his mother because she had a breakdown over his brother’s death (I checked it out and the death was real).  Also he just found out his wife has cancer AND he’s still trying to sort out what happened with his books … but we’ll get paid!!  We sent our sympathies … waited a week and followed up again (seems cold but we no longer trusted him).  We advised him that while we sympathized with what he was going through both in his personal and business life, he still needed to take care of business, this was just too far gone with not a single payment.  We wanted him to give us his VISA number to get the debt paid while he “sorts things out on his end”.

If it magically turned out we made a mistake and ended up owing him money (but we didn’t) we’d pay him back.  Delay, delay, delay, Aug 25 he emailed us that we was going through for a RE-FI and that his cell phone was m.i.a.  He just picked up a new phone with an older restore, he’s keep us posted.  We asked when the re-financing would be final and when could we expect payment?  No reply.  On or around September 1st my husband got a phone call from the police saying that they had arrested someone and found my husband’s phone number on his cell phone.

Police are still accepting information and Mr. Latour’s next court date is October 28th in Cornwall.

None of the allegations have been proven as fact as of yet.   Mr. Latour has refused comment to CFN.

One person was reported taken to CCH for respiratory issues.  Power is also reported off in the area; but it isn’t clear if a transformer blew or it was done as a precaution.

The house at 367 Alice is reported to be the same that had a body found in it last year.  Could the ghost possibly have nibbled at the wires and could this be the beginning of clearing space for Mayor Kilger’s promised East End park?

We will update as more info becomes available.
